Bungie fails to provide evidence for Destiny 2 copyright lawsuit because the content is ‘vaulted’ by Chris Scullion for Video Games Chronicle

"The Red War and Curse of Osiris legacy builds can no longer run because their outdated code is incompatible with Destiny 2’s underlying operational framework, which has evolved considerably since the Red War and Curse of Osiris campaigns were retired...

...As a result, Bungie cannot feasibly provide the Court with the original Destiny 2 game as it existed in 2017, including the accused Red War and Curse of Osiris campaigns, in any operable or reviewable form. Nor will Bungie be able to produce the accused campaigns in operable or reviewable form if this matter proceeds to formal discovery.”

We need active software as evidence of a story in Destiny? Where are the documents that the team wrote the story in? Where are old builds? Why can't the courts learn more at Bungie.net?

The courts have rejected YouTube let's plays and wiki lore entries, which, I'll admit, I sort of thought was the logical asset to turn to. A plot is a plot. A cutscene is a cutscene. I promise, the story in Destiny did not go much deeper than that.

It is rich that the live service game can't defend itself in court or prove any sort of history because it is a live service game. The only proof that I have that the wizard came from the moon is a tee shirt. Was Peter Dinklage in Destiny? There is no way to know now. What an absolute joke.

To be clear, Bungie is the joke. I hadn't even heard of this case until this article. If they stole from Matthew Kelsey Martineau, they should pay up. If they can't dismiss the case because of the ephemeral nature of their game, they should have to defend it in court.
